Crl.O.P.No.22748 of 2022 G.K.ILANTHIRAIYAN, J.

The petitioner, who was arrested and remanded to judicial custody on 31.07.2022 for the offences punishable under Sections 294(b), 323, 324, 506(ii) of IPC in Crime No.328 of 2022 on the file of the respondent police, seeks Anticipatory bail.

2. The case of the prosecution is that there was a money dispute already existing between the petitioner and the defacto complainant, due to which, the petitioner along with another went to the defacto complainant's house and scolded him with filthy language, in turn, he questioned against him, they assaulted him with iron rod, threatened him with dire consequences and also caused injuries to him. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent would submit that the petitioner along with another assaulted the defacto complainant with deadly weapons and caused injuries to him. He would further submit that the injured has been discharged from the hospital and he would also submit that there are four previous cases pending as against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Considering the nature of offence committed by the petitioner this Court had dismissed the earlier anticipatory bail petition filed by the petitioner in Crl.O.P.No.19250 of 2022 dated 16.08.2022 and that there is no change of circumstances. Hence, this Court is not inclined to grant Anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 21.09.2022 vsn
