ORDER
This petition has been filed to quash the FIR registered in Crime No.87 of 2019 pending on the file of the 1st respondent. 2.
Heard M/s N.S.Tanvi, learned counsel for the petitioner and Mr. A. Damodaran, learned Additional Public Prosecutor for 1st respondent.
3.
It is not necessary for this Court to go into the various grounds that have been raised in this petition on the merits of the case. The FIR has been registered for offence under Section 505
(1) (b), 505 (1) (c)and 505 (2) dated 02.03.2019 and till date, no final report has been filed.
4.
Under Section 468 (2) (c) of Cr.PC, the final report ought to have been filed within a period of three years from the date of incident failing which there is a bar in taking cognizance of the final report. In this case, it is more than four years since the FIR was registered and hence, even if a final report is filed, it cannot be taken cognizance in view of the bar under Section 468 (2)(c) of Cr.PC. On this ground alone, the FIR is liable to be quashed by this Court.
5.
In the light of the above discussion, the FIR in crime No. 87 of 2019 on the file of the Central Crime Branch-I, Chennai is hereby quashed. Consequently, the connected miscellaneous petition is closed.
