PRAYER: Writ petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records relating to impugned order in Form MOV-09 bearing Order No.1690/23-24 dated 18.12.2023 passed by the Respondent and quash the same as the same being arbitrary, devoid of merits, passed in violation of the principles of natural justice, passed in contravention to the provisions of law and consequently direct the respondent to refund the amount of penalty of Rs.8,06,914 paid by the petitioner.

When the matter was taken up for hearing, the learned counsel appearing for the petitioner as well as the Respondent submitted that the impugned order has been withdrawn by virtue of order dated 22.08.2024 and a copy of the same is produced before this Court. It is further submitted that the prayer in this writ petition has become infructuous.
