Respondent Prayer: Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the respondents for their Willful and deliberate disobedience in implementing the order of this Court dated 01.09.2021 passed in W.P.No.15939 of 2021.

O R D E R

This contempt petition is filed alleging non compliance of the order passed by this Court on 01.09.2021 in W.P.No.15939 of 2021.

2. In compliance of the order passed by this Court dated 03.03.2023, learned Advocate Commissioner has filed a report dated 27.04.2023, wherein it is stated that alleged encroachments have been removed except 5 cm pillar, which is a crucial part of the building. It is further stated removal of the said pillar may lead to collapse of the entire house.

3. Taking note of the Advocate Commissioner's report dated 27.04.2023 and accepting that the Respondents will not do any further construction encroaching the road, this Contempt Petition stands closed. A sum of Rs.15,000/-(Rupees Fifteen Thousand only) shall be paid to the learned Advocate Commissioner, by the Respondent towards additional remuneration, within period of fifteen days from the date of receipt of a copy of this order. No costs.
