The financial institution / lender, which had approached this Court previously and obtained an order of attachment, seeks to raise the said attachment.
2. In the affidavit in support of this application, at paragraph 4, the applicant has stated that the liability was discharged by the respondent by making payments as per details set out in the table therein. Pursuant to the discharge of liabilities, it is also stated that a NOC was issued by the applicant. In the facts and circumstances, this application is liable to be allowed.
3. Since the lender, at whose instance the order of attachment was issued, seeks to raise the attachment, the order passed in this application would enure to the benefit of the respondent. As such, notice to the respondent is dispensed with.
