ORDER

This Criminal Miscellaneous Petition has been filed by the petitioners, seeking suspension of sentence imposed by the learned Sessions Judge, Mahila Court (Fast Track Mahila Court), Vellore, Vellore District in Spl. C.C. No.220 of 2021 dated 23.06.2025, and enlarge the petitioners on bail pending disposal of the above appeal.

2. The petitioners herein are the accused in Spl.S.C.No.26 of 2021 on the file of the learned Sessions Judge, Mahila Court (Fast Track Mahila Court), Vellore, Vellore District. They were found guilty for the offences punishable under Section 498A & 306 of I.P.C. They have been convicted and sentenced to undergo rigorous imprisonment for a period of two years each and to pay a fine of Rs.5,000/- each, in default to undergo simple imprisonment for a period of three months for the offences under Section 498A of I.P.C and has been sentenced to undergo five years of rigorous imprisonment each and to pay a fine of Rs.50,000/- each in default to undergo simple imprisonment for a period of six months each for the offences under Section 306 of I.P.C. The said sentences were directed to run

consecutively. Aggrieved by the same, the present appeal has been filed.

3. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the respondent.

4. This Court finds no reasons to suspend the sentence since the Trial Court has gone through the evidence in its entirety and also finds that the petitioners have committed very serious and heinous offence as against the deceased and as such she committed suicide. However, a perusal of evidence of P.W.1 clearly shows that even before her suicide, the deceased was beaten up by the petitioners herein.

5. In the result, the petition for suspension of sentence is dismissed. (2/2) Index : Yes/No : Yes/No Speaking/non-speaking order
