This application has been filed seeking to condone the delay of 98 days in filing the written statement, which had been verified by the 2nd defendant and also the Adoption Memo filed by the 1st and 3rd defendants. In filing the written statement and in filing the Adoption Memo, there is a delay of 98 days.
2. In the affidavit filed seeking to explain the delay, it had been stated that though the written statement should have been filed on or before 06.06.2022, the 2nd defendant had fallen ill, owing to viral fever and had then to leave to USA to attend urgent work. It was stated that therefore necessary instructions could not be given to the learned counsels.
3. Heard the learned counsel for the plaintiff also.
4. In view of the reasons stated, the delay is condoned and the written statement verified by the 2nd defendant and the Adoption Memo filed by the 1st and 3rd defendants is taken on record.
