C.M.P.No.16419 of 2022 in S.A.No.1087 of 2021 and C.M.P.No.20682 of 2021 P.T. ASHA, J, The above application is filed for an injunction restraining the 4th respondent from putting up any building in the 1st item of the suit property.
2.When the matter came up for hearing on 11.11.2022, the learned Special Government Pleader (Education) had requested time to get instructions from the Officials as to whether constructions have been put up. Hence, this Court had directed the learned Special Government Pleader (Education) to get an affidavit from the 4th respondent/Department giving details as to whether any construction has been commenced in the suit schedule property or any steps in this regard has been initiated.

ASHA, J, mps 3.Today when the matter is called an affidavit of Mr.M.Ramakrishnan, Chief Education Officer has been filed wherein at Para 3 the following undertaking has been sworn to: "3.It is further submitted that in view of the aforesaid pending Second Appeal, I undertake that no construction on the said land will be made till the disposal of the above Second Appeal and this undertaking may be recorded and further orders may be passed as this Hon'ble Court deems fit in the circumstances of the case."
Recording this Undertaking, this Civil Miscellaneous Petition is disposed of.
