C.M.P.No. 19476 of 2022 in C.R.P. No. 5027 of 2011 T.V. THAMILSELVI, J.

This petition has been filed seeking to set aside the order dated 29.07.2019 dismissing the Civil Revision Petition for default.

2. Earlier, this court by an order dated 19.10.2022 condoned the delay of 1113 days in filing the petition to restore the C.R.P. in C.M.P.No. 16112 of 2022 on hearing both sides.

3. Mr.N.Kannan, learned counsel for revision petitioner submitted that due to unaware of listing of this C.R.P., he could not appear on the date of hearing and represent the matter. However, the Civil Revision Petition was dismissed for default. Hence, he has filed the above petition to restore the above C.R.P.

4. Mr.P.Ganesan, learned counsel for respondents appeared and submitted that he has no objection for allowing this petition and also undertakes to file vakalat on behalf of respondents.

5. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit filed in support of the petition seeking to restore the Civil Revision Petition, this Court is inclined to allow this petition and to restore the C.R.P

6. Registry is directed to print the name of Mr.P.Ganesan for M/s.C.S.Associates, learned counsel for respondents in the cause list and post the C.R.P. on 22.11.2022.
