2. It is seen from the records that the first respondent had remained exparte before the Tribunal. Hence, notice to the first respondent is dispensed with.
3. Mrs. C.Bhuvana Sundari, learned counsel appears for the second respondent/Insurance Company.
4. Accepting the reasons assigned in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is allowed and the delay of 146 days in preferring the appeal is condoned.
