This Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.17408 of 2024 vide order dated 24.07.2024 permitting the defacto complainant to withdraw the amount of Rs.1,00,000/- (Rupees One Lakh Only) to be deposited by the petitioner in the crime number.

The learned counsel for the petitioner would submit that this Court while granting anticipatory bail to the petitioner had directed the petitioner to deposit a sum of Rs.1,00,000/- to the credit of Crime Number and the defacto complainant was permitted to withdraw the said amount by making undertaking affidavit before the Court below. The learned counsel submitted that the petitioner is a Practicing Advocate and he is no way connected with the alleged offence. However, the petitioner is ready to deposit the said amount as directed by this Court and that the condition in respect of permitting the defacto complainant to withdraw the deposit amount alone may be modified to the effect that subject to the outcome of trial, the defacto complainant may be permitted to withdraw the amount. 3.

Considering the submissions of the learned counsel for the petitioner, this Court is inclined to modify the condition No.6(c) alone imposed by this Court in Crl.O.P.No.17408 of 2024 dated 24.07.2024 to the effect that the defacto complainant is permitted to withdraw the amount that would be deposited by the petitioner subject to the outcome of trial. 4. Further, the time is extended by two weeks from the date of receipt of a copy of this order to comply with the conditions imposed by this Court. 5.Accordingly, the Criminal Miscellaneous Petition is ordered. 12.09.2024 ksa-2 Page No.2/3
