PRAYER : Criminal Original Petition filed under section 528 of BNSS to call for the records from the Respondent Police Pertaining to the FIR No.173/2025 dated 10.06.2025 on the file of the First Respondent and Quash the same and pass such further and other relief/orders in the nature and circumstances of the case as this court may deem fit and proper in the aforesaid facts and circumstances of the case.

ORDER

This Criminal Original Petition has been filed to quash the First Information Report registered in No.173/2025 dated 10.06.2025 on the file of the First Respondent as against the petitioners and two other accused.

2. On the complaint given by one Anandan, a case in Crime No.173 of 2025 for the alleged offences under sections 115[2], 118[1], 296[b], 324[2] and 351[3] of BNS is registered. The petitioners are arrayed as accused 3 and 4. The case of the prosecution is that the accused have abused the defacto complainant and attacked him. According to the petitioner, they have not

committed any offence and a false case has been registered against them. It is the further contention of the petitioners that the complaint has been given with an ulterior motive after a lapse of 11 days of the alleged incident. Hence, submitted that the First Information against the petitioners cannot be sustained.

3. The allegations in the First Information Report, prima facie, indicate cognizable offence which requires proper investigation. When the allegations, prima facie, discloses ingredients of the offences, the First Information Report has to be proceeded for its logical end. The Court cannot interfere during investigation, unless and until the First Information Report is a clear abuse of process of law and the materials do not constitute any offence. Hence, I do not find any merits in this petition to quash the First Information Report. 4.

Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 11-08-2025
