Respondents Common Prayer: Civil Revision Petition filed under Article 227 of the Constitution of India, to set aside the order dated 06.09.2022 passed by the learned XXVIII Assistant Judge, City Civil Court, Chennai in E.P.No.3664 of 2015 in O.S.No.10827 of 2010 on the file of VI Addl. City Civil Court, Chennai.

For R1 to R3 : Mr.V.P.Rajendran COMMON ORDER These Civil Revision Petitions have been filed seeking to set aside the order dated 06.09.2022 made in E.P.No. 3664 of 2015 in O.S.No.10827 of 2010 on the file of VI Addl. City Civil Court, Chennai. 2.Today, when the matter is taken up for hearing, the learned counsel appearing for both the parties submitted that the matter has been settled between the parties and they have entered into a Joint Compromise Memo. 3.A Joint Compromise Memo dated 28.01.2025, which has been signed by both the parties is placed before this Court, wherein it is agreed between both the parties that the claim amount has been restricted to a sum of Rs.37,50,000/- out of which Rs.9,50,000/- has been deposited by the revision petitioner in E.P.No.3664 of 2015. The respondents 1 to 4 herein are entitled to withdraw that amount from the concerned Court. The remaining amount of Rs.28,00,000/- (Twenty Eight Lakhs Only) will be 4/8

paid by the revision petitioner on or before 28.07.2025. 4.The Joint Compromise Memo dated 28.01.2025 filed by the parties is taken on file. A separate affidavit is also filed by the revision petitioner in this regard, which is also taken on record. Accordingly, it is made clear that if the revision petitioner fails to make the payment as agreed by the parties on or before 28.07.2025, the revision petitioner is liable to pay the entire amount of execution proceedings. The order of the Executing Court dated 06.09.2022 in E.P.No.3664 of 2015 shall be kept in abeyance till 31.07.2025. If the amount as agreed by the parties in the Joint Compromise Memo dated 28.01.2025 is made by the revision petitioner, the Executing Court shall terminate the execution proceedings. If the revision petitioner fails to make the payment, the Executing Court shall proceed with the execution proceedings.

5.In the result, these Civil Revision Petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 5/8
