2/6 PRAYER Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to pay the admitted sum of Rs.1,01,86,196- together with interest @ 12% per annum in respect of the supply of fire crackers to the 3rd respondent 'PAPSCO' during 'Diwali 2017' forthwith and with a stipulated time as maybe fixed by this Court in terms of the order bearing No.48381/ DCS&CA / PAPSCO / Legal / 2025 / 33 dated 05.03.2025 passed by the 2nd respondent.

ORDER
This writ petition has been filed for issue of writ of mandamus directing the respondents to deal with the representation made by the petitioner on 24.03.2025, wherein, the petitioner wants the respondents to act upon the proceedings of the Government of Puducherry, Department of Civil Supplies and Consumer Affairs dated 05.03.2025, where an offer was made to the petitioner to accept the principal amount alone and the petitioner has also agreed for the same.
3/6 2.Heard Ms.B.Aparnasundar, learned counsel appearing on behalf of the petitioner and Ms.V.Usha, learned Additional Government Pleader appearing on behalf of respondents 1 to 3.
3.The case of the petitioner is that they had supplied fire crackers to the 3rd respondent and towards the said supply, a total of Rs.1,01,86,196/- was due and payable to the petitioner. The petitioner was making repeated demands and ultimately, through proceeding dated 05.03.2025, the Government of Puducherry took a decision to offer to the petitioner payment of only the principal amount and to waive the entire interest. If this offer was acceptable to the petitioner, it was informed to the petitioner that sufficient funds will be allocated in the budget for the financial year 2025-26 with the approval of the Government 4.Pursuant to the above proceedings, the petitioner expressed their intention to receive the principal amount by waiving the interest. The grievance of the petitioner is that in spite of the said representation, no further steps were taken and
4/6 the amount was not settled. It is under these circumstances, the present writ petition came to be filed before this Court.
5.Taking into consideration the facts and circumstances of the case and considering the proceedings dated 05.03.2025 issued by the Government of Puducherry and the representation made by the petitioner dated 24.03.2025, there shall be a direction to the respondents to act upon the same and to settle the principal amount to the petitioner, within a period of twelve weeks from the date of receipt of copy of this order.
