PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the 4th respondent to remove the classification of Kuttai in the New FMB Sketch in respect of the petitioner's property in Survey No. 56/3A situated at Marukkalampatti Village, Puthur East Group, Tiruchengode Taluk, Namakkal District and consequently issue the correct FMB Sketch as in the old FMB Sketch by considering the petitioner's representation dated 22.05.2024. ORDER
This writ petition has been filed seeking to direct the 4th respondent to remove the classification of 'Kuttai' in the new FMB sketch for the property more fully described in the prayer to this writ petition. 2.The petitioner had given a representation to the 4th respondent on 22.05.2024 for the aforesaid purpose. Since the said representation was not considered by the 4th respondent, the petitioner has filed this writ petition.
3.Till date the private respondent viz., the 6th respondent is yet to file his counter. However, the learned counsel appearing for the 6th respondent opposes the representation of the petitioner.
4.No prejudice will be caused to the respondents if the petitioner's representation as stated supra is considered on merits and in accordance with law, after hearing the objections of the 6th respondent as well as any other third party, whom the 4th respondent deems it fit to enquire, within the time frame to be fixed by this Court.
5.This Court is not expressing any opinion on the merits of the petitioner's representation dated 22.05.2024.
6.For the foregoing reasons, this Court directs the 4th respondent, the competent authority to pass final orders on merits and in accordance with law on the petitioner's representation dated 22.05.2024, seeking for removal of classification of 'Kuttai' in the new FMB sketch for the property more fully described in the prayer to this writ petition, after hearing the objections of the 6th respondent and any other third party, whom the 4th respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
