ORDER

This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 315 days in filing the above Criminal Revision Case against the order dated 26.03.2024 passed in Crl.M.P.No. 525 of 2024 on the file of XVIII Metropolitan Magistrate, Saidapet, Chennai.

2. Mr.R.Prabhakaran, learned counsel for petitioner submitted that he he was aged about 60 years old and due to difficulties compounded in running his few small-scale business, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of August 2025, he gave papers to him, as a result of which, there is a delay of 315 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition on condition that the petitioner is directed to pay a cost of Rs.2000/- payable to the learned Government Advocate (Crl. Side) within a period of one week on or before 14.10.2025. Registry is directed to number the Criminal Revision Case if it is otherwise found to be in order and post the matter on 14.10.2025.
