O R D E R

The Petitioner, who is presently residing at Nallathur, Konnerikuppam Village, Tindivanam Taluk, Villupuram District, has come up with this Petition seeking transfer of H.M.O.P. No.3 of 2019 from the file of Sub Court, Maduranthagam to the file of Sub Court, Tindivanam to be tried along with H.M.O.P. No.137 of 2018.

According to the Petitioner, her parents are aged and may not be in a position to accommodate her for each hearing to Maduranthagam and that it would be difficult for her to travel without anyone accompanying her to attend the hearings in H.M.O.P. No.3 of 2019.

3. Learned counsel for the petitioner submitted that the respondent has been served about the pendency of the proceedings before this court. None appears on behalf of the Respondent in spite of his name printed in the cause list, after service.

4. Heard the learned counsel for the Petitioner.

5. There is nothing on record to suspect the bonafides in filing this Transfer Petition. I am therefore of the view that the Transfer Petition deserves to be allowed. Page No.1 of 2 https://hcservices.ecourts.gov.in/hcservices/

6. In the result, the proceedings in H.M.O.P. No.3 of 2019 is withdrawn from the file of Sub Court, Maduranthagam and is transferred to the file of Sub Court, Tindivanam, to be tried along with H.M.O.P. No.137 of 2018. The learned Subordinate Judge, Tindivanam is expected to conclude the trial, as expeditiously as possible, without adjourning the matter beyond 30 working days at any point of time, to bring the issue to a logical end.

7. The Transfer Civil Miscellaneous Petition is allowed as indicated above. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
