ORDER

This petition is filed for issuing a direction to the learned Judicial Magistrate, Walajha to issue original R.C.book bearing Registration No.TN 29 AH 9354, in connection with the case in C.C.No.66 of 2016.

2.Learned counsel for the petitioner submits that the petitioner's vehicle was missing and subsequently, it was traced out. The case has been registered, charge sheet has been filed and the same was taken on file in C.C.No.66 of 2016. Then the petitioner has filed an application for interim custody of the vehicle and that the vehicle has been returned to the petitioner. But R.C. book is yet to be returned. Hence, the petitioner has come forward with this petition for the above stated relief.

3.Heard the learned Additional Public Prosecutor. 4.Considering the submissions made on both sides, interim custody of the vehicle alone was issued to the petitioner. Since the vehicle is the material object in https://hcservices.ecourts.gov.in/hcservices/

C.C.No.66 of 2016, its R.C.book and Insurance policy are kept with the Judicial Magistrate's Court, Walajha, till the disposal of C.C.No.66 of 2016. Therefore, the petitioner is not entitled to obtain original R.C.Book and the Criminal Original Petition stands dismissed as devoid of merits. 5.At this juncture, learned counsel for the petitioner seeks early disposal of C.C.No.66 of 2016. On considering his request, the learned Judicial Magistrate, Walajha, is directed to dispose of C.C.No.66 of 2016 within a period of three months from the date of receipt of a copy of this order. kj Sd/- Asst.Registrar /true copy/ Sub Asst.
