ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 18.10.2021 for the offences under Section 302 IPC @ into Sections 294(b), 302 and 201 IPC, in Crime No.169 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant is the father of the deceased and the petitioner is the husband of the deceased. The defacto complainant's daughter was found murdered near his Paddy field. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is the husband of the deceased and based on a false complaint lodged by his father-in-law, the petitioner has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for about 40 days from 18.10.2021 and hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the petitioner suspected the character of the deceased due to which, the occurrence had happened and that the post-mortem report is awaited.

5.On seeing the nature of allegation levelled against the petitioner and that investigation is at the initial stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
