Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus, directing the first respondent to permit the petitioner to join duty as per the order of the 2nd respondent dated 12.09.2013 in L.Dis.8502/E4/13 and to issue posting orders to the petitioner.

O R D E R

While working as Tutor at Coimbatore Medical College, the petitioner took 27 days leave. It is the case of the petitioner that the second respondent issued a memo dated 06.02.2006 calling upon the petitioner to explain as to why action should not be taken on account of his unauthorised absence. The petitioner submitted his reply to the said memorandum. Thereafter, nothing was heard. It is the grievance of the petitioner that he was not permitted to join duty.

2. The second respondent vide communication dated 12.09.2013 informed the petitioner that he would be permitted to join duty subject to the instruction to be given by the Director of Medical Education, Chennai. The petitioner now seeks a direction to the respondents to permit him to join duty forthwith.

3. Heard the learned counsel for the petitioner and the learned Special Government Pleader on behalf of the respondents. https://hcservices.ecourts.gov.in/hcservices/

4. The petitioner is given liberty to submit a comprehensive representation to the first respondent in the light of the communication dated 12.09.2013. In case any such representation is made, the first respondent is directed to consider and dispose of the same on merits and as per law, as expeditiously as possible and in any case within a period of four weeks thereafter.

5. The writ petition is disposed of with the above direction. No costs.
