Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition to appear before the trial court on the first working day of every two months at 10.30 A.M. imposed on the petitioner by this Honourable Court in Crl.M.P.No.13512 of 2018 by order dated 09/10/2018 pending appeal in C.A.No.170 of 2018 on the file of this Honourable Court and thus render justice.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.C.SUNDARESAN, Advocate for the petitioner and of M/S K.SRINIVASAN, SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- Earlier, this Court by an order dated 09.10.2018 modified the condition that the petitioner shall report before the learned XII Additional Special Judge for CBI Cases, Chennai once in two months on the first working day of the month at 10.30 a.m. starting from the month of December 2018. Now, to relax the said condition, the present petition has been filed.
2. Today, when the matter taken up for hearing, Mr. C.Sundaresan, learned counsel appearing for petitioner would submit that, the petitioner is a lady and she is complying with the condition regularly from the year 2018 and due to some medical complications, she find it difficult to comply with the condition. 3. Considering the facts and circumstances and also considering the fact that the petitioner is regularly complying with the condition imposed by this Court, this Court is inclined to modify the condition to the effect that the petitioner shall report before the learned XII Additional Special Judge for CBI Cases, Chennai once in six months, on the first working day of the month, at 10.30 a.m. starting from 04.01.2022 until further orders. -sd/- 08/12/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
