The petitioner, who was arrested on 19.06.2025, for the offence punishable under Sections 392, 394 r/w 397 of IPC under N.B.W. in connection with S.C. No.641 of 2021, registered on the file of the respondent, seeks bail.
2. The case of the prosecution is that the learned Trial Court had issued a Non-Bailable Warrant (NBW) against the petitioner/accused on 13.06.2025 and the said warrant was executed on 19.06.2025, after which the petitioner has been remanded to judicial custody.
3. It is further alleged that the petitioner wilfully evaded the process of law and failed to appear before the Court on the scheduled hearing, thereby causing delay in the judicial process. The prosecution apprehends that if released on bail, the petitioner may again abscond or tamper with the witnesses.
4. The learned counsel for the petitioner submitted that the petitioner was unable to appear before the learned Trial Court on 13.06.2025 due to a genuine threat to his life allegedly posed by the opposite party. It is submitted that 2/5
the petitioner is innocent and has been falsely implicated in the case. The petitioner is ready to abide by any conditions imposed by this Hon'ble Court and undertakes to appear regularly before the Trial Court in future.
5. The learned Government Advocate (Crl. Side) appearing for the respondent opposed the bail petition on the ground that the petitioner deliberately absented himself from the Court proceedings, leading to issuance of NBW. It was also submitted that granting bail at this stage would set a wrong precedent and affect the progress of the trial, particularly when the case is at an advanced stage.
6. This Court has carefully considered the arguments made by both sides and gone through the records. It is clear that the petitioner did not cooperate with the trial earlier, which led to the issue and execution of a Non-Bailable Warrant. The reason given by the petitioner for not appearing before the Trial Court is not convincing and is not supported by any proper evidence. 3/5
7. The case is now at the stage of recording evidence and granting bail at this point may delay the trial. Therefore, this Court is not incllined to grant bail at this stage. However, considering that the petitioner is in custody, the Trial Court is directed to complete the trial and dispose of the case within a period of two months from the date of receipt of this order.
