PRAYER This Criminal Original Petition is filed under Section 528 of BNSS, to set aside the order passed in CRL.MP.No.1573 of 2025 dated 09.06.2025 by the Principal Sessions Judge, Salem.

ORDER

This Criminal Original Petition has been filed to set aside the order dated 09.06.2025 passed in CRL.MP.No.1573 of 2025 by the Principal Sessions Judge, Salem.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent-Police and perused the materials available on record.

3. The respondent-Police registered a case in Crime No.119 of 2025 against the accused persons for the offences under Sections 191(2), 191(3), 296(b), 115(2), 118(1) and 351(3) of the BNS. In the meanwhile, the petitioner herein and other accused filed petition under Section 482 of BNSS, in Crl.M.P.No.854 of 2025 before the learned Principal Sessions Judge, Salem 2/5

seeking to grant anticipatory bail. The learned Sessions Judge vide order dated 21.3.2025, granted anticipatory bail on certain conditions. Subsequently, the petitioner along with other accused filed Crl.M.P.No.1573 of 2025 seeking to relax the bail condition imposed on them. The learned Sessions Judge, vide order dated 09.6.2025, dismissed the petition. Challenging the impugned order dated 09.06.2025 passed in CRL.MP.No.1573 of 2025 by the Principal Sessions Judge, Salem, the petitioner has filed this criminal original petition.

4. It is submitted by the learned Government Advocate (Crl.Side) appearing for the respondent-Police submitted that Investigation was over and charge sheet has been filed.

5. In view of the above facts and circumstances of the case and also considering the submissions made by the learned counsel on either side, this Court is inclined to relax the condition imposed on the petitioner in CMP No.854 of 2025 to the effect that the petitioner shall appear before the learned Judicial Magistrate No.II, Salem or before the trial Court, as the case may be, once in a month ie., every first Monday of English Calendar Month, at 10.30 am.

6. With the abovesaid direction, this Criminal Original Petition is disposed of.
