Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of writ of mandamus, directing the respondent to disburse the statutory entitlement namely 30% solatium with interest till the day of payment, in the light of judgment of Honourable Supreme court of India in the matter in Union of India and Another Vs Tarsem Singh and others in Civil Appeal No.7064 of 2019 by considering petitioners representation dated 13.04.2023 within time framed manner.

ORDER

This writ petition has been filed directing the respondent to disburse the statutory entitlement namely 30% solatium with interest till the day of payment, in the light of judgment of Honourable Supreme court of India in the matter in Union of India and Another Vs Tarsem Singh and others in Civil Appeal No.7064 of 2019 by considering petitioners representation dated 13.04.2023 within time framed manner.

2. The learned counsel for the petitioners would submit that the petitioners has made a representation dated 13.04.2023 to the 1st respondent seeking to disburse the statutory entitlement namely 30% solatium with interest till the day of payment. However the said representation was not considered by

the respondents till date. Hence, this petition has been filed by the petitioners.

3. Mrs.S.Indhu Bala, learned Special Government Pleader, appears on behalf of the respondents and requests this Court to pass appropriate orders.

4. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondent and also perused the materials available on record.

5. In view of the above, this Court directs the 1st respondent to consider the petitioners' representation dated 13.04.2023 on its own merits and dispose of the same in accordance with law within a period of six weeks from the date of receipt of copy of this order, after affording reasonable opportunity of hearing to the petitioners.
