This application has been filed by the 4th defendant seeking to condone the delay of 201 days in filing the written statement.

2. In the affidavit filed, it had been stated that the 4th defendant had filed counter in the applications and had also contested them. Necessary instructions could not be given to file the written statement and there has been a delay of 201 days.

3. Since it would only be appropriate that the averments made in the written statement are also considered and a Judgment is passed on merits in the Civil Suit, the delay in filing the written statement by the 4th defendant is condoned and the written statement is taken on record.

4. The application stands allowed.
