This petition is filed to condone the delay of 23 days in filing the above criminal appeal.

2. Heard the learned counsel for the petitioner.

3. Private notice sent to the respondent has been returned with an endorsement "No such person in the address" and Affidavit of Service filed to that effect. Despite the name of the respondent has been printed in the causelist, none appeared on behalf of him either in person or through his counsel. It is seen that the respondent has got no serious objection in condoning the delay.

4. Being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay stands condoned and the petition is ordered.
