The Petitioner, who apprehends arrest at the hands of the Respondent police for the offence punishable under Section 9 & 10 of Child Marriage Act, in Crime No.511 of 2023 on the file of the Respondent police, seeks anticipatory bail.
2.When the matter is taken up for hearing, learned Government Advocate (Crl. Side) would submit that statement of the victim under Section 164 of Cr.P.C., has not yet been recorded in this matter and opposed for grant of anticipatory bail to the Petitioner.
3.In view of the submissions made by the learned Government Advocate (Crl. Side) that statement under Section 164 of Cr.P.C., has not yet been recorded in this matter, this Court is not inclined to grant anticipatory bail to the Petitioner.
