ORDER

This Criminal Original Petition has been filed by the petitioner to direct the first respondent to transfer the investigation in Crime No.12 of 2024 dated 05.10.2024 registered for the offences under Sections 419, 465, 468, 471, 420 and 34 of IPC, on the file of the second respondent herein, to any other investigating agency on the ground that till date no action has been taken against the accused persons and despite explaining the in ability of the Principal to travel to India from USA, the police officials are stressing the petitioner/power agent to bring the Principal to verify her identity.

2. The learned Government Advocate (Crl. Side) submitted that it is a case of impersonation. Therefore, the finger prints of the Principal and the impersonator have to be verified for which, the signature and thumb impression of the Principal are required and despite sending of summons, the Principal, who is in abroad, is not co-operating for the enquiry and without her finger prints and signature, the further progress cannot be shown. 2/5

3. Heard both sides and perused the materials available on record.

4. It is seen that there is no fault on the part of the investigating agency and due to fault on the part of the petitioner/defacto complainant, the respondent police could not proceed with the further investigation. Therefore, the petitioner is not entitled to the relief sought for.

5. Accordingly, this Criminal Original Petition is dismissed.

6. However, the petitioner and the Principal are directed to extend their fullest co-operation to the respondent police for investigation and on such cooperation, the respondent police is directed to expedite the investigation and file the final report as early as possible.
