A.No.4376 of 2022 is filed to condone the delay of 2851 days in filing the written statement of third defendant and adoption memo of defendants 1, 5 and 6 in C.S.No.236 of 2014.

2.The learned counsel for the applicants/defendants submitted that the written statement was filed even in the year 2015 and it was given Dairy No.34821 of 2015. It was returned for compliance of certain defects. However, the then learned counsel on record omitted to comply the defects and therefore this caused the delay.

3.The learned counsel for the respondents/plaintiffs submitted that he has no objection for condoning the delay of 2851 days in filing the written statement.

4.Considering the reasons stated in the affidavit and also the fact that the pleadings in this case is not yet completed and that learned counsel for the respondents/plaintiffs has no objection, this Court allows this application. 1/3
