ORDER

This Criminal Original Petition has been filed to direct the second respondent to register the case based on the petitioner's complaint dated 28.10.2021 and to investigate into the matter in accordance with law and to file a final report before the competent court of law.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents.

3. The learned counsel for the petitioner submitted that the petitioner has given a sum of Rs.16,00,000/- as a loan to one Sharmila Samson, on the promise that she would sell her property to the petitioner; but after receiving the said amount, Sharmila Samson did not sell the property to the petitioner; when the petitioner asked her to return the money, she had given a cheque for Rs.16,00,000/-; when the cheque was presented to the Bank, the same was returned by stating that the account was closed; therefore, the petitioner gave a complaint to the second respondent police on 28.10.2021; since no action was taken on the said complaint, the petitioner is before this Court.

4. The learned Government Advocate (Crl.Side) submitted that on

the complaint given by the petitioner, CSR Number has been assigned in CSR No.558 of 2021; enquiry has been initiated and the same is pending.

5. In view of the above submission of the learned Government Advocate (Crl.Side), the second respondent police is directed to complete the enquiry and file a final report within a period of two weeks from the date of receipt of a copy of this order.

6. With the above observations, this Criminal Original Petition is disposed.
