C.M.P.No.21193 of 2024 in S.A.No.1233 of 2009 C.V.KARTHIKEYAN, J.

This application has been filed seeking to condone the delay of 1342 days in filing the restoration petition in Second Appeal which was dismissed on 06.11.2020.

2.In the affidavit filed in support of the petition, it had been stated that the 1st respondent died on 02.01.2011 but no steps were taken to bring on record her legal representatives. In the meanwhile, on 06.11.2020, the Second Appeal was dismissed. It had been stated that the petitioner was undergoing medical treatment for health problem during the Covid period. 3.Notice had been earlier directed and an affidavit of service had been filed indicating that intimation had been given to the respondents. There is no appearance for the respondents.

4.In view of the reasons stated, the delay is condoned and this petition stands allowed.

5.List the matter whenever the petition to restore is filed and numbered by the Registry.
