The petitioners/A2 & A3 who apprehend arrest at the hands of the respondent/Police for the offences punishable under Sections 406, 420 IPC and Section 76(1) of Chit Funds Act, 1982, in Crime No.924 of 2022, seek anticipatory bail.
2.The case of the prosecution is that the petitioners, along with other accused, conducted unregistered chit and collected money to the tune of Rs.34,27,450/- from the de-facto complainant and public and had cheated the de-facto complainant. Hence the complaint.
3.The learned counsel for the petitioners would submit that the first petitioner is the wife of A1 and the second petitioner is the mother of the first petitioner. He would further submit that the first accused has been arrested and remanded in judicial custody and as far as the petitioners are concerned, there is no allegation against them. He would further submit that the petitioners are innocent persons and they have nothing to do with the alleged offences. msm 4.Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent would submit that the petitioners, along with other accused, conducted unregistered chit and they have collected money to the tune of Rs.34,27,450/- from the de-facto complainant as well as public and had cheated the de-facto complainant. He would further submit that the first accused has been arrested and still in judicial custody. He would further submit that the case is in the initial stage of the investigation and therefore, custodial interrogation of the petitioners is very much required and thereby, he opposed for grant of anticipatory bail to the petitioners.
5.Taking into account the nature of offences and the fact that the case is in the initial stage of the investigation, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
