Writ Petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to pay the petitioners the amount of Rs. 37,490/- payable as wages towards 60 days of earned Leave, the amount of Rs. 23,783/- payable as wages towards 45 days of earned Leave, the amount of Rs. 23,650/- payable as wages towards 45 days of earned Leave, the amount of Rs. 36,682/- payable as wages towards 60 days of earned Leave, the amount of Rs. 24,183/- payable as wages towards 45 days of earned Leave, the amount of Rs. 35,493/- payable as wages towards 60 days of earned Leave, respecitively surrendered by them while they were in service as admitted by the respondent in their RTI together with 18 percentage from the date of his retirement within a time frame as may be fixed by this Hon'ble Court and pass such orders accordingly.

The learned counsel for the petitioners would submit that when the petitioners have retired on superannuation on various dates, they have not been settled the amount of Earned leave surrendered by them. In this connection, the petitioners have sent representations to the respondent seeking the amount of earned Leave along with interest as per the details given below:

3. Heard the learned counsel for both sides and perused the materials available on record.

In view of the said fair submission made by the learned Standing Counsel, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondent to pay the claim of the Earned Leave to the petitioners herein along with interest @ 6% p.a. within a period of eight weeks from the date of receipt of copy of this order. 3/4
