The petitioner namely Sathish, who was arrested and remanded to judicial custody on 01.07.2023 for the offences punishable under Section 420 IPC in Crime No.256 of 2023 on the file of the respondent police, seeks bail.

2. Learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime No.256 of 2023 for the offences under Section 420 IPC. Petitioner is in judicial custody from 01.07.2023. Thus, he prays for dismissal of this petition.

3. Learned Additional Public Prosecutor opposes this petition, on the ground, the accused in this case have spurious jewelleries. On the promise of selling jewellery at low price, the accused cheated the defacto complainant. On the promise made by the accused, defacto complainant had parted with 9 grams of his gold ring. The accused after receiving the gold ring of the defacto complainant had escaped. The defacto

complainant found that, the jewellery given to him is a spurious jewellery. He further submitted that, petitioner is involved in a similar case in Crime No.238 of 2023. The investigation in this case is completed, but final report is not taken on file. Thus, he prays for dismissal of this petition.

4. Considering the nature of the offence alleged against the petitioner, that petitioner had one similar case pending against him, possibilities that petitioner may involve in similar offence, if released on bail, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 30.08.2023 gd
