Heard Ms. K.Jenitha, Learned Counsel for the Petitioner, Mrs. V.Yamunadevi, Learned Special Government Pleader appearing for the First and Fourth Respondents, Mr. P.Srinivas, Learned Counsel for the Second Respondent and Mr. V.Vijayashankar, Learned Counsel for the Third Respondent and perused the materials placed on record, apart from the pleadings of the parties.

This Contempt Petition is prosecuted for failure of the Respondents to comply with the order dated 07.03.2022 in W.P. No. 4992 of 2022 passed by the Court.

Learned Counsel for the Third Respondent has brought to notice that the First Respondent by G.O. (4D) No. 09, Municipal Administration & Water Supply (MC.4) Department dated 16.03.2023 has granted exemption under Rule 49(6)(3) of the Tamil Nadu Pension Rules in favour of the Petitioner for grant of family pension and that further proposals for pension would have to be sent by the Second Respondent. Learned Counsel for the First, Second and Fourth Respondents, on instructions, state that the Second Respondent would send necessary proposal within a period of two weeks. In such circumstances, the Petitioner shall co-operate and furnish necessary details in that regard. It is made clear that if the Petitioner still has any grievance to be redressed in the matter, he is not precluded from working out his rights before the proper forum in the manner recognized by law.

In fine, the Contempt Petition is closed with the aforesaid clarifications. No costs.
