ORDER

Mr.T.M.Naveen, learned Counsel on record for the petitioners and Ms.R.Anvitha, representing Mrs.V.Srimathi, learned Counsel on record for the Respondent Nos.1 and 2 are before this Court. 2.Despite sufficient opportunities given, the respondents did not file counter affidavit.

3.This petition is filed under Order IV Rule 9(4) of the Appellate Side Rules, praying to condone the delay of 2726 days in representing the returned case papers in the Cross Objection.

4.In view of the provision under Order 41 Rule 33 of the Appellate Side Rules, this Court is inclined to allow this petition. Accordingly, this petition is allowed.

16.07.2025 MSM Note: Registry is directed to number the Cross Objection in Sr.No. 99332 of 2017 and if it is otherwise in order. List the Appeal Suit on 25.07.2025.
