Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent herein to reinstate the petitioner in his original status in the second respondent's institution to continue the petitioner's 1st year M.C.A course on the basis of the petitioner's last representation dated 13.06.2025. This Writ Petition has been filed for direction directing the first respondent to reinstate the petitioner in his original status in the second respondent's institution and to permit him to continue his 1st year M.C.A course.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner had joined in the second respondent College in the course of Master of Computer Application (MCA) in the Academic Year of 2024-2025. While being so, the petitioner was suspended on 07.02.2025 along with other four students alleging that the petitioner had involved in undesirable activities in campus (manhandling each other and groupism, caused nuisance, disturbance to classes, violated University rules and regulations).

4. The learned counsel for the petitioner would submit that there was ragging committed by the petitioner and four others as against one Mohammed Abrar. Due to which, there was a quarrel between them and as such, the petitioner sustained injuries. On his complaint, the Inspector of Police, Keelampakkam Police Station registered FIR in Crime No.43 of 2025 for the offences punishable under Sections 126(2) and 115(2) of BNS, 2023 and the

investigation is pending. Due to such occurrence, the petitioner was suspended for not committing any fault. In fact, the petitioner protected he said Mohammed Abrar from the hands of the accused in Crime No.43 of 2025. Now, the petitioner is undergoing prolonged suspension from 07.02.2025.

The second respondent filed counter and on the submissions made by the learned counsel for the second respondent revealed that the petitioner and four others involved in ragging of one Mohammed Abrar. Due to which, there was a quarrel between them and the petitioner sustained injury. It was against the Code of Conduct and as such, the petitioner was suspended from the class and now, the enquiry is pending. Only because of this writ petition and the pendency of the FIR, no order has been passed so far. She also pointed out the Campus Rule 21 and it states that the students tried at the Court of Law or facing an FIR suit will be expelled from the Institution. Further, every student is required to observe utmost discipline and decorum both inside and outside the campus and not indulge in any activity which adversely affect the prestige/reputation of the Institute.

6. However, the petitioner is not an accused and only on his complaint, the FIR has been registered against the accused persons. In fact, the petitioner also sustained injuries. Therefore, the Campus Rule 21 does not apply in the

case of the petitioner. However, under the caption of students discipline, the respondents have to conduct enquiry. After registration of FIR, the other three students who involved in ragging, now obtained Transfer Certificate from the second respondent institution.

7. In view of the above, the second respondent is directed to conduct enquiry as against the petitioner and pass orders, within a period of two weeks from the date of receipt of a copy of this order, in the light of the above observations made by this Court.

8. With the above directions, this writ petition stands disposed of. No costs.
