Crl.O.P.Nos.19007 & 19026 of 2023 G.CHANDRASEKHARAN.J., The petitioners namely Sakthivel and Deepa, who were arrested and remanded to judicial custody on 07.07.2023 and 18.07.2023 respectively for the offences punishable under Sections 174 of Cr,P.C., subsequently altered into Sections 109, 120-B, 302 and 365 of IPC in Crime No.26 of 2023 on the file of the respondent police, seeks bail.

The learned counsel for the petitioners submitted that, petitioners are innocents and they have been falsely implicated in a case registered in Crime No.26 of 2023 for the offences under Sections 174 of Cr,P.C., subsequently altered into Sections 109, 120-B, 302 and 365 of IPC in a murder of one Sakthivel. Petitioners are in Judicial Custody from 07.07.2023 and 18.07.2023 respectively. Thus, he seeks bail to the petitioner.

3. In response, learned Additional Public Prosecutor submitted that, deceased and Deepa, who is the 4th accused in this case are husband and wife. Deepa developed illegal intimacy with one Sukumar, who is the first accused in this case. Therefore, they plotted to do away the 1/3

deceased with the help of the other accused. On 15.03.2023, they had engaged the deceased under the guise of driving the car. Then, they took him to Veeranam Lake near Kaliamalai. A2 and A3 held the hands of the deceased. A1 murdered the deceased by strangulation and then they thrown the body in the Veeranam Lake. Investigation in this case is pending.

4. Considering the nature and seriousness of the offences alleged to have been committed by the petitioner and having regard to the fact that, investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, these Criminal Original Petitions are dismissed.
