CRL.O.P.No.26873 of 2016 Dr.P.DEVADASS, J., Petition for anticipatory bail in Crime No.9 of 2016 for offence under Sections 417, 506(i) of I.P.C. and r/w 4 of Women Harassment Act.

2. Heard both sides.

3.The defacto complainant who is living away from her husband alleged that the petitioner dissuaded her, promised to marry her and now, refused to marry her.

4.The learned counsel for the petitioner submitted that the defacto complainant went upon marrying him and with that intention, she has filed this complaint.

5.It is pertinent to note that the defacto complainant is a married woman. As on date, she has not obtained divorce from a competent forum.

6. In the facts and circumstances, I am inclined to grant him anticipatory bail.

7. Ordered as under:- (i) Anticipatory bail granted.

(ii) Petitioner shall surrender before the learned XVII Metropolitan Magistrate Court, Saidapet, Chennai, within 15 days of receipt of a copy of the order;

(iii) Petitioner shall execute a bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate;

(iv) Petitioner shall appear before the respondent police as and when required for interrogation.
