Writ Petition filed under Article 226 of the Constitution of India to issue a writ of certiorarified mandamus calling for the records relating to Form III in Notice No.960/P.A/File-11/dated 29.07.2024 of the 4th respondent and quash the same and consequently direct the respondents to follow the directions issued by this Court in T.S.Senthilkumar Vs. Government of Tamil Nadu and others reported in 2010(3) MLJ 771 for the proceedings under Tamil Nadu Protection of Tanks and Eviction of Encroachments Act, 2007.

ORDER

[Order of the Court was made by M.SUNDAR, J.] Mr.K.Sakthivel, learned counsel for writ petitioner and Mr.T.K.Saravanan, learned Additional Government Pleader for all the respondents are before this Court.

2. Learned counsel for writ petitioner and learned State counsel submit in one voice that the writ petitioner has since been evicted and therefore, the captioned main WP has become infructuous. This submission is recorded.

3. Be that as it may, learned counsel for writ petitioner submits that the writ petitioner will be making an application for alternate accommodation. Though obvious, we make it clear that if such an application is made, the same will be considered by State on its own merits and in accordance with law (subject of course to writ petitioner satisfying eligibility criteria) and we express no opinion one way or the other on this plea for alternate accommodation.

4. In the light of the narrative thus far, captioned WP and captioned WMP can be given a closure. We do so.
