.. Respondents Prayer: The writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to appoint the petitioners as Village Administrative officer.

O R D E R

The relief sought for in this writ petition is for seeking to issue a direction to the respondents to appoint the petitioners as Village Administrative officers.

2. The first writ petitioner claims that on account of non implementation of certain Government orders, the first writ petitioner was deprived of getting his appointment to the post of Village Administrative Officer. Further, from the affidavit filed in support of the first writ petitioner, it is stated that during the relevant point of time there was a ban on recruitment and therefore, the first petitioner was unable to be appointed. https://hcservices.ecourts.gov.in/hcservices/

The grievance of the first petitioner is that though he was qualified for appointment to the post Village Administrative Officer, his case was not considered on account of the ban imposed by the Government and thereafter, the Government orders were not implemented scrupulously.

3. Appointment can never be claimed as a matter of right. The person who is eligible cannot seek appointment by way of filing a writ petition. A mere participation in the process of selection will not confer any right to selection or order of appointment. The writ petitioners have not established any illegality or irregularity in the matter of selection for appointment to the post of Village Administrative Officer.

4. This apart, even at the time of filing the writ petition, the first petitioner was aged about 56 years and now he would be of 63 years of age. Thus, the cases of the writ petitioners deserves no further consideration. Accordingly, the Writ Petition is dismissed. However, there shall be no order as to costs.
