Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 to 4 to remove the encroachment made by respondents 5 to 9 in the State Highway connecting Thaigadurgam to Sankarapuram in S.No.141/1B and 5B, Kalaiyanallur Village, Vanapuram Taluk, Kallakurichi District. ORDER
(Order of the Court was made by the Hon'ble Acting Chief Justice) Alleging that respondents 5 to 9 have encroached on the State Highway connecting Thaigadurgam to Sankarapuram in S.No.141/1B and 5B, Kalaiyanallur Village, Vanapuram Taluk, Kallakurichi District, the petitioner sent a representation on 31.5.2024 to respondents 1 to 4 seeking removal of the said encroachment. As no action was taken based on the said representation, the present writ petition is filed.
2. Considering the narrow scope of the prayer made in the writ petition, without going into the merits of the matter, we direct respondents 1 to 4 to consider the representation of the petitioner
dated 31.5.2024 and pass appropriate orders, on merits and in accordance with law, of course after affording an opportunity to all the interested persons, including respondents 5 to 9. The entire exercise shall be concluded within a period of twelve weeks from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly. There shall be no order as to costs. Consequently, W.M.P.No.27799 of 2024 is closed.
