CMP No.24511 of 2023 in CMA.SR.No.95502 of 2023 N.ANAND VENKATESH.,J Notice to the first respondent is dispensed with since the first respondent remained ex-parte before the Tribunal. The second respondent has been served with notice and is represented through counsel.

2.This Civil Miscellaneous petition has been filed seeking to condone the delay of 396 days in filing the Civil Miscellaneous Appeal.

3.Heard the learned counsel for the Appellants and perused the records.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 396 days is condoned.

5.The name of the counsel appearing for the second respondent shall be printed in the cause list at the time of admission.

6.It is made clear that for the period of delay of 396 days, the appellants will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.

7.Post the case for admission along with CMA.Nos.863, 209 and 394 of 2023.
