ORDER

The petitioner has come forward with this petition seeking a direction to the respondent police to register FIR in connection with the complaint dated 17.12.2015 on the file of the respondent police.

2.The learned counsel for the petitioner submitted that the proposed accused has given false statement against the petitioner and hence, the petitioner has preferred a complaint dated 17.12.2015 to the respondent, but the respondent has not shown any interest to enquire the matter and register the case. Hence, the petitioner has come forward with this petition for the above stated relief.

3.A perusal of the complaint would show that one Saravanan has called for information against this petitioner and on the requisition Tamil Nadu Information Commission has given an information in which some derogative statement finds place. So, he submits that it amounts to defame his name. Hence, he wants https://hcservices.ecourts.gov.in/hcservices/

the respondent to register a case as per Section 499 and 500 of I.P.C.

4.At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that the petitioner ought to have filed a private complaint against the wrong doer as the matter is now under investigation.

5.Considering the rival submissions made on both sides and recording the submissions of the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed. It is open to the petitioner to prefer private complaint on the wrong doer.
