Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, forbearing the first respondent from opening the tender documents in respect of tender notice No.17/202324/HDO, dated 28.07.2023 of the first respondent herein in respect of the works under Sl.Nos.5, 8 and 12 Strengthening and Culvert works to the Government roads in Tindivanam (H) C&M Sub Division Jurisdiction (VPM 060); widening, strengthening and culvert works to the Government Roads in Tindivanam (H) C&M Sub Division Jurisdiction (VPM 063) and Improvements to riding quality and culvert works to the Government roads in Gingee (H) C&M Sub division jurisdiction (VPM067) without issuing the quality certificate to the petitioner and receiving 1/4

the bids of the petitioner.

ORDER

The petitioner intends to participate in the tender floated by the State Highways Department, for which he should have obtained a quality certificate. Therefore, the petitioner has made a representation before the second respondent, however, the same has not been considered. 2.Learned counsel for the petitioner submitted that the certificate has since been issued to enable the petitioner to participate in the tender, the learned counsel seeks the leave of the Court to withdraw this Writ Petition.

4.In view of the above submission, this petition stands dismissed as withdrawn. No Costs. Consequently, the connected miscellaneous petition is closed.
