Heard learned counsel for the petitioner.

2.Ms.Janani, learned counsel would submit that Mr.J.Chandran takes notice for the 3rd respondent / Insurance Company and she has serious objection in allowing the above petition. 3.Despite the receipt of notice and the name of the 2nd respondent having been printed in the cause list, he neither appeared nor entered appearance through his counsel.

4.The petitioner would aver that though the award passed on 12.02.2021 in MCOP No.485 of 2017, on the file of MACT, Additional District Court, Hosur, the award amount is deposited only in the year 2023. He would further aver that due to financial constraints, a delay of 1156 days occurred in preferring the appeal.

5.Accepting the reasons stated in the affidavit, this petition is ordered on the condition that the interest for the delay period shall stand waived.
