Both the defendants have jointly filed the application to condone the delay of 90 days in filing the written statement. Learned counsel for the plaintiffs submit that he has no serious objection to this application being allowed.

Upon examining the affidavit in support thereof, I find that the applicants have stated that the suit summons was served on a staff of the second defendant but was not handed over to the person concerned.
