ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 06.10.2021 for the offences under Sections 419 and 420 IPC and Sections 66C and 66D of Information Technology Act 2000 in Crime No.174 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner opened a GST registration by misusing the KYC particulars of the defacto complainant namely Manisha Arunraj and also forged the defacto complainant's signature for opening bank account with Kotak Mahindra Bank. By using the GST licence under the name and style of MMM Enterprises, transactions were made to the tune of huge amount and it was brought to the knowledge of the defacto complainant only by GST tax officials and that the defacto complainant received an order stating that a sum of Rs.1,74,76,963/- has to be paid as penalty for violation of GST norms . 3.The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and that he has been falsely implicated in this case and that he has been suffering incarceration for more than 52 days from 06.10.2021. Hence, he would pray for grant of bail to the petitioner. 4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the amount involved is more than Rs.1 Crore and that the investigation is at the initial stage. 5.On seeing the grave nature of offence and the allegations in the FIR needs a detailed enquiry and that the investigation is at the initial stage, this Court is not inclined to grant bail to the petitioner.
