Respondent PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondent to issue a patta in the name of the petitioners in relating to survey No.299/3A measuring an extent of 4800 Sq.fts., which is situate Kodambakkam Village, Mambalam-Guindy Taluk, Chennai District within a stipulated period of time as fixed by this Court.

O R D E R

This Writ Petition has been filed to direct the respondent to issue a patta in the name of the petitioners in relating to survey No.299/3A measuring an extent of 4800 Sq.fts., which is situate Kodambakkam Village, Mambalam-Guindy Taluk, Chennai District within a stipulated period of time as fixed by this Court.

2. The property in survey No.299/3A measuring to an extent of 34 cents of Kodambakkam Village, Mambalam Guindy Taluk originally belong to one M.Dharuma Naicker. Thereafter, the said Dharuma Naicker and his sons joined together and divided the said property and sold the same to the petitioners and his mother totally measuring an extent of 4800 sq.ft. property, 2400 sq.ft. was purchased in the name of the petitioners by way of sale dated dated 01.03.1988. The petitioners submitted a representation to the respondent on 24.04.2008 for transfer of patta in the name of the petitioners by producing all the required documents. But till date no action has been taken on the said representation and hence, the present Writ Petition has been filed.

3. Heard the learned counsel for the petitioners and the learned Special Government Pleader for the respondent.

In view of the submissions made on either side, this Court, without going into the merits of the claim made by the petitioners, directs the respondent to dispose of the representation of the petitioner dated 24.04.2008 on merits and in accordance with law, as expeditiously as possible and the Writ Petition is disposed of accordingly.
