This petition is filed to condone the delay of 108 days in filing the above Civil Miscellaneous Appeal.

2. There is no representation on behalf of the petitioner/ appellant. The learned counsel for the 2nd respondent has no objection for this petition being allowed.

3. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is allowed.

4. It is made clear that the petitioner/ appellant will not be entitled to any interest for the above period of delay.
